In these Terms and Conditions, 'School' is defined as the School hosting the Animal Club (as set out in your application form).

  1. The club established by the School under these Terms and Conditions shall be known as 'the School's Animal Club'. In signing these Terms and Conditions, the Principal of the School on behalf of the School endorses or will endorse any activities to be carried out by the School's Animal Club.

  2. The purposes of Animal Club, including the School's Animal Club, are and will be to:
    1. foster respect and compassion for animals;
    2. raise awareness of animal protection issues;
    3. encourage children to be advocates against animal cruelty;
    4. introduce animal protection education into the school system; and
    5. help animals through the actions of students.

  3. The School's Animal Club Leader must be:
    1. a qualified teaching staff member of the School; or
    2. the parent/guardian of a student currently enrolled at the School.

  4. If the School's Animal Club Leader is a parent/guardian of a student currently enrolled at the School, the parent/guardian must be approved by the Principal of the School as appropriate to lead the School's Animal Club.

  5. The Principal of the School will notify Voiceless within seven days of there being a change in the School's Animal Club Leader. Such notification should include contact details for the newly appointed School's Animal Club Leader.

  6. The School's Animal Club membership shall be open to all students currently enrolled in the School.

  7. Voiceless may from time to time and in its absolute discretion offer seed funding, grants, prizes or other incentives to recognised Animal Club for Animal Club projects ("Funding"). Funding may include an annual prize of $5,000 for the school that Voiceless considers is deserved of being awarded the title 'the most humane school'. If the School's Animal Club is the recipient of Funding from Voiceless, any Funding received must only be used:
    1. to assist the School's Animal Club to fulfil its purposes described at Clause 2 above; and
    2. in accordance with the terms and conditions of Seed Funding provided by Voiceless at the time the Seed Funding is offered.
    This clause will continue to apply despite any change to the School's Animal Club Leader.  In the event that the Animal Club becomes inactive or ceases to exist, a representative of the school should contact Voiceless for guidance as to how any residual Funding should be spent.

  8. All expenses incurred in connection with the School's Animal Club will be incurred at the School's own expense and neither Voiceless nor its related or associated entities, their directors, officers, employees or agents will be under any obligation to provide funding or reimbursement for any expenses incurred of any kind whatsoever in relation to the School's Animal Club activities.

    1. The following activities are inconsistent with the purpose of Animal Club and will not be undertaken as the School's Animal Club activities:
      1. breeding animals at the School for food or other purposes;
      2. keeping wild animals in captivity at the School; or
      3. visiting zoos, circuses and similar venue

    2. Although Voiceless does not endorse the activities referred to in clause (a) above, the carrying out of such activities by the School (independently) of Animal Club will not constitute a breach of these Terms and Conditions.

  9. If requested, Voiceless will provide the School with a copy of the 'Animal Club' logo for use on printed or promotional material prepared in connection with the School's Animal Club activities. However the School acknowledges that all intellectual property rights in the logo remain the property of Voiceless at all times and the School is only permitted to use the logo in the manner described. Voiceless may require any use of the logo which it considers improper to cease or be corrected if, in its reasonable opinion, such use is contrary to the purposes of Animal Club as identified at Clause 2 above, or the Voiceless Mission and Priorities.

  10. As a registered member of Animal Club, Voiceless will provide the School with membership cards, activity ideas, regular Animal Club newsletters and phone/email support for the School's Animal Club Leader.

  11. The School's Animal Club will not:
    1. purport to speak or act on behalf of Voiceless or its related or associated entities;
    2. enter into any agreement on behalf of Voiceless or its related or associated entities; or
    3. take public policy positions in the capacity of Animal Club that are contrary to the purpose of Animal Club or the Voiceless Mission and Priorities.

  12. Subject to any applicable legislation and departmental policies, the School will be solely responsible for obtaining parent/guardian/student consent (where required) of all participating students, for Voiceless to publish on the internet or otherwise, photographs or images of any of the School's students participating in Animal Club activities, including consent to identify the student in any such publication, limited by reference to the student's first name only, with no other identifying and/or contact details of the Student to be given. The School will ensure that parents/guardians of any student participating in the School's Animal Club will sign a Publicity Authorisation Form (available here and by emailing This e-mail address is being protected from spam bots, you need JavaScript enabled to view it ) prior to the student participating in the School's Animal Club.

  13. The School authorises the use or reproduction of any documents, photographs or other work that the School has provided to Voiceless for any reasonable purpose within the discretion of Voiceless without being entitled to remuneration or compensation.

  14. The School will be solely responsible for obtaining the consent of parents/guardians or students (where appropriate) for Voiceless to publish student work and undertakes to obtain that consent prior to providing student work to Voiceless.

  15. Voiceless will use its best endeavours to maintain an effective working relationship with the School.

  16. Voiceless reserves an absolute discretion to terminate registration of the School's Animal Club for breach of any of the Terms and Conditions or for any other reason at any time. Termination will take effect at the time that the School is notified in writing by Voiceless.

  17. The School agrees and acknowledges that Voiceless is not involved in the process of selecting or assessing the suitability of any person to carry out the role of the School's Animal Club Leader.

  18. The School releases Voiceless and its related or associated entities, and their directors, officers, employees and agents from any claims, demands or proceedings of any kind whatsoever arising out of, or associated with, any of the School's Animal Club activities during or after School hours and/or on or outside the School's premises.

  19. The School will indemnify Voiceless and its related or associated entities, and their directors, officers, employees and agents from any costs, expenses or damages of any kind whatsoever incurred or suffered by Voiceless arising out of, or associated with, any of the School's Animal Club activities during or after School hours and/or on or outside the School's premises. Despite the provisions of Part 4 of the Civil Liability Act 2002 (NSW), the School acknowledges that it is solely responsible for any negligent act or omission on the part of the School, its employees and agents (including the School's Animal Club Leader).

  20. Voiceless may vary or amend these terms and conditions at any time.  Any changes to these terms and conditions will be effective immediately from the time Voiceless posts the amendments to this website. 

  21. This Agreement is governed by and subject to the law in the State of New South Wales.
